Only 5 Days left to make an Enduring Power of Attorney

There are now only five days left in which to make an enduring power of attorney before the law changes on 1 October and the more expensive and complex lasting power of attorney takes effect.

Solicitors are working flat out as friends and relatives of the elderly rush to put in place an enduring power of attorney which is a fairly simple process.

You can make an Enduring Power of Attorney for around £30 but the cost of setting up and registering an LPA after 1st October could easily reach £1,000. The simpler and cheaper EPA will still be effective after 1 October, if drawn up before, but no new EPAs will be possible after that date.

Should you make an Enduring Power of Attorney

In our opinion everyone should have an EPA, even if it is not needed immediately. You can create an EPA and simply choose to leave it with your Will, or in another safe place, so that it is always available should it be required at a later date. It can only be used if the original is given to the attorney, who would then have to produce it to others to prove that they are actually authorised to act on your behalf. The attorney will be aware of its existence as they have to sign the EPA too, and you will need to make them aware of where the original is going to be kept, so that they can use it if needs be.

Enduring Power of Attorney

The law is changing but this has been put back until October 2007. It is widely accepted that anyone wishing to make an Enduring Power of Attorney (EPA) should do so before that date.

After October 2007 the enduring power of attorney will be replaced by the new Lasting Power of Attorney but all EPAs made before that date will remain valid.
